New Carpet/New Paint

Hi there,
My housemate and I are at odds with asking our agent/home owner for new carpet (again). We have asked numerous times. The home owner just wont do it. The carpet has been a state since we moved in and we have been asking ever since. We have even offered to do a trade off - we will get the apt painted if you do the carpets. Today we received a letter advising that the rent is going to increase. We would like to carpet to be changed before we agree to the increase however Im not sure that we have a leg to stand on. We are great tennants, we pay the rent on time, look after the property and have even offered to get the apt painted. We are at a loose end. We dont want to have to take it any further to the tenancy tribunal. We would rather settle this within ourselves. Can you offer any advice - Thanks

It really depends on what state the carpet is in? How bad is it? It does come to a point where the carpet has to be in a condition that is suitable for general living.

Hi AJ, the carpet is pretty bad. Wine stains, dark patches, movers sticky tape stuck to the carpet. Its probably more unsightly and makes the apt look really dirty. It more than the usual"wear and tear". Its pretty gross. Do you know if there is a standard template letter that we can use? OS.

Hi OceanSt,

I've done a little research about what your options are. While a nice letter may only get you so far, you could take it up with Consumer Affairs. A think a phone call to them might help you out, and at the very least they will probably be able to give you some guidance. Here is their website with some information:
