Homely’s ‘Spring Suburb Review’ Promotion

Terms and Conditions

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents over the age of 18 years old at the time of entry.
  3. Employees and Directors (and their immediate families) of the Promoter and agencies associated with this promotion may not enter into the competition and are ineligible to win a prize. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, stepsister or 1st cousin.
  4. The competition commences at 12:01am AEDT on 06/10/2021 and ends at 11:59 pm AEDT on 12/12/2021 (“Competition Period”).
  5. This competition is a game of skill. The Homely marketing team will select the most helpful suburb review. To enter, consumers need to leave at least one suburb review before 12 December 2021 that is deemed ‘helpful’ based upon individual: (a) information that could potentially help an individual find a suburb interesting; (b) insight that potentially could help positively inform home buying decisions; (c) creativity such as writing style; and/or (d) brand reflection, where the author writes in a way that is clear and easy to understand. The most helpful suburb review as voted by Homely will win a share of a $5000 cash prize. There will be a first prize of $3,000, followed by two runner up prizes of $500 (totaling $1000). There will be 10 x $100 e-Gift cards awarded to entrants as voted by Homely.
  6. Incomplete entries, entries that are deleted due to content that violates our content policy will be deemed invalid.
  7. Competition is only open to Australian residents.
  8. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions, tampers with the entry process or engages in any unlawful or other improper misconducted calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  9. Multiple entries permitted however only entries that satisfy the requirements and comply with our content policy will be considered as valid or eligible.
  10. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant and disqualify if promoter deems necessary.
  11. The winners will be chosen at Homely, 22/55 Collins Street Melbourne, VIC Australia 3000. The Promoter may select additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn.
  12. All winning entrants will be notified by email on 15th of December 2021.
  13. The Promoter’s decision is final and no correspondence will be entered into.
  14. Suburb reviews must be original and owned by the entrant. Using other peoples’ commentary as it exists on the Homely.com.au site will not be considered.
  15. Prize(s) are final and cannot be exchanged for anything else. Cash will be deposited from Homely to the recipient via EFT for first place and the two runners ups. The remaining ten successful entries will receive an e-Gift card. The gift cards are not redeemable for cash. If incorrect details are provided to Homely Pty Ltd the promoter will not be liable. The onus of providing correct information at the time of notification resides with the winners.
  16. Any ancillary costs associated with creating entries will not be refunded and are the sole responsibility of the entrant.
  17. Subject to the unclaimed prize draw clause, if for any reason a winner does not take/redeem a prize within 30 days of our communication to the winner(s), the prize may be offered to a runner-up chosen by the Homely team.

  19. By entering the competition, you give permission for Homely to use your suburb review(s) for this and/or other promotions/competitions in the future without remuneration.
  20. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  21. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  22. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; (f) use or redemption of a prize; or (g) any other reason arising in any way out of or in connection with the promotion.
  23. The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter will also use and handle this information as set out in its privacy policy, which can be viewed at https://www.homely.com.au/privacy-policy. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages. Entrants should direct any request to opt out, access, update or correct information to the Promoter. All entries become the property of the Promoter. By entering the promotion, each entrant agrees that the Promoter may use the entrant’s personal information in this way. The Promoter will not disclose entrant’s personal information to any entity outside of Australia.
  24. Each winner is responsible for providing valid contact details for communication and liaising with the Promoter to coordinate the transfer of the prize to the winner.
  25. Any cost associated with accessing a promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.
